My car was parked and I was at work. My car has been estimated to have between 2100-4500 in body damage. I dont have the money to fix it, so I am having to drive around my mashed up car. Your insurance company needs to abrogate the damages to the motorcyclists insurance company.  I assume you do not have collision insurance, because if you did, then you would be covered regardless.&lt;br&gt;&lt;br /&gt;&lt;br /&gt;You should begin by calling your insurance company, and asking why the debt was not abrogated to the motorcyclists insurance. &lt;br&gt;&lt;br /&gt;&lt;br /&gt;Do not take no for an answer. Eventually you will wear them down.&lt;br&gt;Reply:The cycle driver is legally liable for the damages to your vehicle.   Get an estimate of the damages from a body shop you like. You should then send a %26quot;demand letter%26quot; to the cyclist, by certified mail, letting him know that if he doesn%26#039;t pay that amount within a reasonable time - say 30 days - you will take him to court.  Start a file on this with a copy of the demand letter, the police report, etc.  If the cyclist is being prosecuted for the hit-and-run, you may not need a lawyer to sue him. You call them and tell them about the accident and give them the motorcyclist information. This is what insurace is here for; to do the fighting for us. He hit it with his car motorcycle and you will win no matter what...there are always reasons and eXcuse why a driver hits another driver, but they still have to pay.. all accidents are accidents, but he is still responsible.. The motorcyclist is actually the one at fault since he is the one that struck your car. The hit and run motorist was the proximate cause of the accident.   Just because the motorcyclist struck your vehicle does not make him automatically liable for your damages.  You need to prove he was negligent.  Perhaps you can recover a portion of your damages.  If you sue the motorcyclist, he will refer the matter over to his insurance company. There was a car %26quot;parked%26quot; in front of that thing making it perpendicular to my wife%26#039;s car.  My wife looked over her left shoulder and could not see anything because of that dumster, so she looked through the back out her rear window just like you%26#039;re supposed to.&lt;br&gt;&lt;br /&gt;&lt;br /&gt;&lt;br&gt;&lt;br /&gt;&lt;br /&gt;There was nothing there so she continued only to feel a THUD.  She had hit the nose of a car that was poking out past the dumpster.  It really would%26#039;ve been impossible to see.&lt;br&gt;&lt;br /&gt;&lt;br /&gt;&lt;br&gt;&lt;br /&gt;&lt;br /&gt;Technically the person backing out has the burden of the responsibility.  Can%26#039;t say that she is at no fault, because she IS just by the letter of the law.  BUT, the other vehicle would be at fault also, wouldn%26#039;t it?  The other vehicle was not unattended, and it seems as though the lady just hid there to get hit.&lt;br&gt;&lt;br /&gt;&lt;br /&gt;&lt;br&gt;&lt;br /&gt;&lt;br /&gt;Would this be a 50/50, even if, upon explanation, the CHP refused to come out because they claimed it would be 50/50 as well?&lt;br&gt;Wife hit ATTENDED illegally parked vehicle, split fault?&lt;br&gt;Sounds 50/50 to me&lt;br&gt;Wife hit ATTENDED illegally parked vehicle, split fault?&lt;br&gt;I believe it boils down to a question of avoidance.  You really shouldn%26#039;t be backing up unless you can make absolutely certain there is nothing behind you.  If that requires getting out of your car to check so be it.  I usually ascertain whether I have a clear lane to back up before getting into my vehicle.  I assume the other car was already there before she got in?  That person should possibly be cited for illegal parking but I don%26#039;t think they%26#039;re liable for that accident.  Just be happy your wife is ok.&lt;br&gt;Reply:You are funny, the other vehicle was hiding in a deliberate attempt to be hit?  If it was sticking out enough to be hit, it was sticking out enough to see, unless it was under a Harry Potter cape of invisibility.  If it wasn%26#039;t moving, the accident is 100% her fault.  If it is ruled 50-50 by insurance, she should thank her lucky stars, because, illegal parking or not, it is never open season to hit parked cars.&lt;br&gt;Reply:I think the law is pretty clear; If your wife drove her car into another person%26#039;s car, it%26#039;s her fault. You are supposed to be in control of your vehicle at all times. Chalk it up to experience, take responsibility and learn from the mistake. tell your wife not to back anywhere you can%26#039;t see, you can always get out of the car and check first if you are not sure whats back there. Better to be safe...&lt;br&gt;Reply:If the other party was parked, how were they negligent?  Sorry, it does not matter that she may have been illegally parked.  Your wife hit a parked vehicle.  It is possible that you can place some very minor comparative negligence on the other party, but not 50%.&lt;br&gt;Reply:I think your wife is 100% at fault. We asked them to settle for the maximum of $30,000 per person (we were hit by a drunk with no insurance so my uninsured motorist coverage covers $30,000/person) On May 9th they sent a letter to my insurance company asking for the maximum. As of last thrusday they had not responded back yet and their deadline was yesterday. i will know tomrrow if they responded or not. What if they dont? My attorney said it will knock the cap off and we would be allowed to get more.... how does this work and what are the chances of getting more? has this ever happened to anyone or has anyone ever heard of this? My lawyer said he had a case like this last year and they were supposed to settle for $25,000 but ended up getting almost a million!&lt;br&gt;What happens when my insurance doesnt reply to a settlement in the alotted time period?&lt;br&gt;Most likely insurance will not allow that to happen. Where do you think the money would come from?   Don%26#039;t expect to receive more than your policy limits.  It is possible that the insurance company may be acting in bad faith.  It does not sound like it though.  If this is the case depending on what state you live in, you may have a claim against them.  &lt;br&gt;&lt;br /&gt;&lt;br /&gt;&lt;br&gt;&lt;br /&gt;&lt;br /&gt;The insurance adjuster will contact the attorney as soon as he/she evaluates the claim. My car has out-of-state plates, even though I%26#039;ve lived in TX for a few months.  My insurance card wasn%26#039;t with me.  Here%26#039;s my question. If I take a letter from the insurance company to the court, will this citation be dismissed?  Also, I%26#039;ve registered my car now with TX license plates - can I get that fine removed as well?&lt;br&gt;Proof of insurance for out-of-state?&lt;br&gt;if you can show you had insurance at the time of the ticket, there is a good chance they will drop that one.  i am not sure about the registering of the plates in TX.&lt;br&gt;Proof of insurance for out-of-state?&lt;br&gt;If you can prove that you had insurance coverage at the time you were given the citation,  most likely that will be dropped.  Now as far as having outdated registration and lived in Texas for a few months without changing them over,   that fine is more than likely going to stick,  because you usually have a certain amount of time,  usually 10 to 30 days,  depending on what Texas requires,   to have your registration changed when you move to another state. The finance company informed us that they could not finalize the deal until my husband switched his license, which at the the time he had and out of state license.  In order to do that he need to clear a couple of tickets out of state.  After clearing that up, he received his license 6/3/2008 and return to the dealership, so that they could send his new license to the finance company.  Financing was officially approved 6/5/2008.  The temporary 20 day tag expired 5/26/08, so they issued a dealer tag on that day.  So, on 6/7/08 my husband was pulled over by the police who stated the tag was reported stolen 12/2007. The police officer took the tag leaving us with no way to drive the vehicle.  So I thought no big deal, I%26#039;ll just contact the dealership so they could issue a temporary tag until I get my offical tag.  I was told that they couldn%26#039;t issue me a tag.&lt;br&gt;Can a dealership choose not to reissue a temporary tag or dealer tag?
