My parked vehicle was hit by a motorcyclist who was cut off by another motorist who fled the scene. The motorcyclist had insurance, but the police report said it was a hit and run, so the motorcyclist%26#039;s insurance wont pay for my cars damage. This does not seem fair. My car was parked and I was at work. My car has been estimated to have between 2100-4500 in body damage. I dont have the money to fix it, so I am having to drive around my mashed up car. I have no idea what my legal options are. Should I write the motorcyclist and ask him to pay for the damages personally? Should I contact a lawyer?

Start a file on this with a copy of the demand letter, the police report, etc. If the cyclist is being prosecuted for the hit-and-run, you may not need a lawyer to sue him. He hit it with his car motorcycle and you will win no matter what...there are always reasons and eXcuse why a driver hits another driver, but they still have to pay.. all accidents are accidents, but he is still responsible.. Reply:If you have uninsured motorists insurance on your car, then your insurance will pay for the damage less your deductible. The motorcyclist is actually the one at fault since he is the one that struck your car. That he chose to make an unsafe reaction to the threat to him is of no consequence.

The motorcyclists insurance company may %26quot;tell%26quot; you they aren%26#039;t liable but it is up to you to make a %26quot;claim%26quot; and if they won%26#039;t pay, then you sue the motorcyclist for the damage.

If an insurance company can convince you they aren%26#039;t liable long enough for you to not make a claim, they get to keep the motorcyclists premiums and your damage money as well.
Reply:It does not sound as if the motorcyclist is liable for your damages. The hit and run motorist was the proximate cause of the accident. Just because the motorcyclist struck your vehicle does not make him automatically liable for your damages. You need to prove he was negligent. Perhaps you can recover a portion of your damages. If you sue the motorcyclist, he will refer the matter over to his insurance company. They will continue to defend him.

My wife was parked at a gas station adjacent to one of those concrete buildings where they hold the dumpsters. There was a car %26quot;parked%26quot; in front of that thing making it perpendicular to my wife%26#039;s car. My wife looked over her left shoulder and could not see anything because of that dumster, so she looked through the back out her rear window just like you%26#039;re supposed to.

There was nothing there so she continued only to feel a THUD. She had hit the nose of a car that was poking out past the dumpster. It really would%26#039;ve been impossible to see.

Technically the person backing out has the burden of the responsibility. Can%26#039;t say that she is at no fault, because she IS just by the letter of the law. BUT, the other vehicle would be at fault also, wouldn%26#039;t it? The other vehicle was not unattended, and it seems as though the lady just hid there to get hit.

Would this be a 50/50, even if, upon explanation, the CHP refused to come out because they claimed it would be 50/50 as well?

I believe it boils down to a question of avoidance. You really shouldn%26#039;t be backing up unless you can make absolutely certain there is nothing behind you. If that requires getting out of your car to check so be it. I usually ascertain whether I have a clear lane to back up before getting into my vehicle. I assume the other car was already there before she got in? That person should possibly be cited for illegal parking but I don%26#039;t think they%26#039;re liable for that accident. Just be happy your wife is ok.

I have made the same type of backing mistake your wife did, and hit a sign that was 2%26#039; high and too low for me to see when I backed up. Still my fault even though the sign was in a stupid place. Chalk it up to experience, take responsibility and learn from the mistake. tell your wife not to back anywhere you can%26#039;t see, you can always get out of the car and check first if you are not sure whats back there. Better to be safe...

My attorney gave my insurance company 30 days to respond to our offer. We asked them to settle for the maximum of $30,000 per person (we were hit by a drunk with no insurance so my uninsured motorist coverage covers $30,000/person) On May 9th they sent a letter to my insurance company asking for the maximum. As of last thrusday they had not responded back yet and their deadline was yesterday. i will know tomrrow if they responded or not. What if they dont? My attorney said it will knock the cap off and we would be allowed to get more.... how does this work and what are the chances of getting more? has this ever happened to anyone or has anyone ever heard of this? My lawyer said he had a case like this last year and they were supposed to settle for $25,000 but ended up getting almost a million!

If you are filing an uninsured claim, you will not get more than your policy limit. Where do you think the money would come from? Don%26#039;t expect to receive more than your policy limits. It is possible that the insurance company may be acting in bad faith. It does not sound like it though. If this is the case depending on what state you live in, you may have a claim against them.

The insurance adjuster will contact the attorney as soon as he/she evaluates the claim. It could be that your attorney did not provide all of the needed supporting documentation, and they had to request the info again or from your providers.

If the matter cannot be resolved, your attorney will have to file UM arbitration.

unfortunately he is legally still responsible for the car note. he really should have made sure he was covered before driving and also that he had gap insurance in place to cover the difference in the loan amount and the actual cash value of the car. even if he had insurance theres a really good chance he would still owe on the car as insurance only pays the ACV not the payoff amt. sorry, he either pays it off or they take the car and file him in collections.

The vehicle has a title issued by another state and is being held by the leinholder. Any state you register the vehicle can only create a registration for you and not a title therefore preventing you from trying to sell the vehicle.

I was pulled over for outdated registration. My car has out-of-state plates, even though I%26#039;ve lived in TX for a few months. My insurance card wasn%26#039;t with me. Here%26#039;s my question. Now as far as having outdated registration and lived in Texas for a few months without changing them over, that fine is more than likely going to stick, because you usually have a certain amount of time, usually 10 to 30 days, depending on what Texas requires, to have your registration changed when you move to another state. My and hsuba I purchased a 2006 Dodge Ram 1500 fon 5/7/2008 . Everything was fine until a week later. The finance company informed us that they could not finalize the deal until my husband switched his license, which at the the time he had and out of state license. In order to do that he need to clear a couple of tickets out of state. After clearing that up, he received his license 6/3/2008 and return to the dealership, so that they could send his new license to the finance company. Financing was officially approved 6/5/2008. The temporary 20 day tag expired 5/26/08, so they issued a dealer tag on that day. So, on 6/7/08 my husband was pulled over by the police who stated the tag was reported stolen 12/2007. The police officer took the tag leaving us with no way to drive the vehicle. So I thought no big deal, I%26#039;ll just contact the dealership so they could issue a temporary tag until I get my offical tag. I was told that they couldn%26#039;t issue me a tag.

Something there is a bit screwy, I would get in touch with an attorney right away and advise him of what you just stated in this question. The dealer issued you a dealer tag that was reported stolen???. Something is very screwy there.

ok so i failed my massachusetts permit test today and im hopeing on going back there tommorow and passing the stupid thing...well anyways can you guys please help find me some sites that have good practice tests and give me some advice to what i should mainly focus my attention twoard while studying tonight? thanks.

Just go to the massachuisetts dmv website and i am sure they have practice tests dont worry it is nearly impossible to fail twice (i failed the first time went back two days later and didnt miss a one- of course that was in kansas)

Try taking the true or false questions it%26#039;s more easier than the a.b,c the multiple choice at the secretary state!

Take all 5 of the %26quot;Regular Driver (Class C License)%26quot; practice tests.

They really helped me, I passed my first time.

Reply:I took the driving permit test Monday I did Great I only missed 3!! I don%26#039;t know how your test works there but just use process of taking out the answers that you know is not the right ones and just do you best!!
Reply:i live in md and i thought the test was pretty easy cuz i got all of them right.

to practice more just google search MA dmv learner%26#039;s permit practice test. i did the same thing when i practiced for it and found a couple of practice tests.
