Does anyone know what happened and who were involved on the accident on the A682 on 8/6/8 about 3pm?

I know there were motorbikes and a van involved...any details would be greatly appreciated.

My accident was considered a hit and run. Insurance wont cover damages to my car. What are my options?

My parked vehicle was hit by a motorcyclist who was cut off by another motorist who fled the scene. The motorcyclist had insurance, but the police report said it was a hit and run, so the motorcyclist%26#039;s insurance wont pay for my cars damage. This does not seem fair. My car was parked and I was at work. My car has been estimated to have between 2100-4500 in body damage. I dont have the money to fix it, so I am having to drive around my mashed up car. I have no idea what my legal options are. Should I write the motorcyclist and ask him to pay for the damages personally? Should I contact a lawyer?

You cannot go after the motorcyclist, because he was not at fault. Any court will see that.





Otherwise, you will have to pay out of pocket to get your car repaired.

The same thing happened to me. My insurance took care of the damages on my car, and then they pursued the other people%26#039;s insurance. I even got a loaner car while my car was fixed.


And, btw, it wasnt %26quot;hit and run%26quot; unless the motorcycle that hit your car %26quot;hit and run%26quot;---there%26#039;s no such thing as %26quot;hit and run%26quot; when someone is cut off and they smash into your vehicle if they stop and exhange information. You are the injured party. Demand that your insurance cover the damage, and also that they pursue the other driver%26#039;s policy as well.

Reply:The fact that the other driver fled the scene does not mitigate the motorcyclists responsibility. Your insurance company needs to abrogate the damages to the motorcyclists insurance company. I assume you do not have collision insurance, because if you did, then you would be covered regardless.


You should begin by calling your insurance company, and asking why the debt was not abrogated to the motorcyclists insurance.


Do not take no for an answer. Eventually you will wear them down.
Reply:The cycle driver is legally liable for the damages to your vehicle. Get an estimate of the damages from a body shop you like. You should then send a %26quot;demand letter%26quot; to the cyclist, by certified mail, letting him know that if he doesn%26#039;t pay that amount within a reasonable time - say 30 days - you will take him to court. Start a file on this with a copy of the demand letter, the police report, etc. If the cyclist is being prosecuted for the hit-and-run, you may not need a lawyer to sue him. The benefits of legal representation in a case like this is that it makes it most likely that you will be able to collect. Good luck!
Reply:Your Insurance company will take care of this. You call them and tell them about the accident and give them the motorcyclist information. This is what insurace is here for; to do the fighting for us. If you don%26#039;t have insurance then you have to press charges against this person and settle the matter in court.
Reply:The motorcyclist who hit your car has to pay for your car... He hit it with his car motorcycle and you will win no matter what...there are always reasons and eXcuse why a driver hits another driver, but they still have to pay.. all accidents are accidents, but he is still responsible.. That mans insurance company is responsible for finding the man he did the hit and run and if he cant they end up being responsible... his car hit your car, thats all there is to it.. why, how, where, and when dont matter, he is RESPONSIBLE.. and like the guy said above, your insurance will do the fighting for you, even if you just have liability

Make sure you get copies of ANY AND ALL documents you can get from ALL PARTIES!





Take those to a lawyer and just ask for their opinion of the situation...

Reply:If you have uninsured motorists insurance on your car, then your insurance will pay for the damage less your deductible. The motorcyclist is actually the one at fault since he is the one that struck your car. That he chose to make an unsafe reaction to the threat to him is of no consequence.





The motorcyclists insurance company may %26quot;tell%26quot; you they aren%26#039;t liable but it is up to you to make a %26quot;claim%26quot; and if they won%26#039;t pay, then you sue the motorcyclist for the damage.





If an insurance company can convince you they aren%26#039;t liable long enough for you to not make a claim, they get to keep the motorcyclists premiums and your damage money as well.
Reply:It does not sound as if the motorcyclist is liable for your damages. The hit and run motorist was the proximate cause of the accident. Just because the motorcyclist struck your vehicle does not make him automatically liable for your damages. You need to prove he was negligent. Perhaps you can recover a portion of your damages. If you sue the motorcyclist, he will refer the matter over to his insurance company. They will continue to defend him.

Reply:Even though you have only liability insurance, I think you should start with your own Insurance company for help and advice. Then you may want to try your states, Insurance commissioners office and or the office of consumer protection to see what the laws are........If that all fails, then you may want to hire a lawyer. Most states require you to reregister your car and drivers license within 30 days of a PERMANENT relocation. Since you are residing in illinois temporarily, and have plans to return within 60 days, you should be fine.

My wife was parked at a gas station adjacent to one of those concrete buildings where they hold the dumpsters. There was a car %26quot;parked%26quot; in front of that thing making it perpendicular to my wife%26#039;s car. My wife looked over her left shoulder and could not see anything because of that dumster, so she looked through the back out her rear window just like you%26#039;re supposed to.





There was nothing there so she continued only to feel a THUD. She had hit the nose of a car that was poking out past the dumpster. It really would%26#039;ve been impossible to see.





Technically the person backing out has the burden of the responsibility. Can%26#039;t say that she is at no fault, because she IS just by the letter of the law. BUT, the other vehicle would be at fault also, wouldn%26#039;t it? The other vehicle was not unattended, and it seems as though the lady just hid there to get hit.





Would this be a 50/50, even if, upon explanation, the CHP refused to come out because they claimed it would be 50/50 as well?

I believe it boils down to a question of avoidance. You really shouldn%26#039;t be backing up unless you can make absolutely certain there is nothing behind you. If that requires getting out of your car to check so be it. I usually ascertain whether I have a clear lane to back up before getting into my vehicle. I assume the other car was already there before she got in? That person should possibly be cited for illegal parking but I don%26#039;t think they%26#039;re liable for that accident. Just be happy your wife is ok.
Reply:You are funny, the other vehicle was hiding in a deliberate attempt to be hit? If it was sticking out enough to be hit, it was sticking out enough to see, unless it was under a Harry Potter cape of invisibility. If it wasn%26#039;t moving, the accident is 100% her fault. If it is ruled 50-50 by insurance, she should thank her lucky stars, because, illegal parking or not, it is never open season to hit parked cars.
Reply:I think the law is pretty clear; If your wife drove her car into another person%26#039;s car, it%26#039;s her fault. You are supposed to be in control of your vehicle at all times. I would be surprised to find any police officer that could call this 50/50





I have made the same type of backing mistake your wife did, and hit a sign that was 2%26#039; high and too low for me to see when I backed up. Still my fault even though the sign was in a stupid place. Chalk it up to experience, take responsibility and learn from the mistake. tell your wife not to back anywhere you can%26#039;t see, you can always get out of the car and check first if you are not sure whats back there. Better to be safe...
Reply:If the other party was parked, how were they negligent? Sorry, it does not matter that she may have been illegally parked. Your wife hit a parked vehicle. It is possible that you can place some very minor comparative negligence on the other party, but not 50%.
Reply:I think your wife is 100% at fault. How can a stopped, parked %26quot;car%26quot; be responsible for an accident caused entirely by your wife ? aside form that. Some states do have a %26quot;law%26quot; that says anyone is automatically at fault for just being there. In My state it is 20% at fault but that is on a road. I%26#039;m not sure about a private parking lot.

Reply:You have to obtain it in the same country you have your regular driver licence in. It has the same number and restrictions as your regular licence. It expires at the same time as your regular licence. It is only valid with your regular licence.


In actual fact it is not a %26quot;licence%26quot;, it is a multi-lingual translation of your licence.
